Board Policy Committee Minutes – July 21, 2020

The Board Policy Committee (BPC) met on Tuesday, July 21, 2020, at 3:00 p.m.

Committee Members Present: Dr. Paul Gausman, Perla Alarcon-Flory, Dr. Juli Albert, Jeremy Saint
and Cyndi Lloyd

Committee Members Absent: None

Guests: Dr. Rita Vannatta, Jen Gomez, Patty Blankenship, and Attorney Maureen Heffernan

BP 405.8 – Child Abuse Reporting: Dr. Rita Vannatta and Jen Gomez

Conclusion: BP 405.8 was reviewed and edited by Dr. Vannatta, Jen Gomez and Attorney Maureen
Heffernan. Revisions to BP 405.8 were approved as presented and will be brought forward to the full Board for first reading on Monday, August 10, 2020.

AR 405.8 – Child Abuse Reporting: Dr. Rita Vannatta and Jen Gomez

Conclusion: AR 405.8 was reviewed and edited by Dr. Vannatta, Jen Gomez and Attorney Maureen
Heffernan. Revisions to AR 405.8 will be included in the July 31, 2020 Informational Update and
updated on the District website once the policy has been approved by the Board.

BP 405.10 – Allegations of Physical or Sexual Abuse of Student by District Employee (NEW): Dr. Rita Vannatta and Jen Gomez (Formerly Part of Board Policy 405.8)

Conclusion: A separate BP was recommended to address Chapter 102 procedures. BP 405.10 was
prepared by Attorney Maureen Heffernan and reviewed by Dr. Vannatta and Jen Gomez. Explanation for the separate policy was provided. BP 405.10 was approved as presented and will be brought forward to the full Board for first reading on Monday, August 10, 2020.

AR 405.10 – Procedures for Charging and Investigating Allegations of Physical or Sexual Abuse of Student by District Employee (NEW): Dr. Rita Vannatta and Jen Gomez

Conclusion: AR 405.10 was drafted by Attorney Maureen Heffernan and reviewed by Dr. Vannatta
and Jen Gomez to accompany the newly numbered policy. AR 405.10 will be brought forward to the full Board for acknowledgment on Monday, August 10, 2020.

BP 803.1 – Internal Controls (NEW): Patty Blankenship

Conclusion: BP 803.1 was created by Ms. Blankenship based on the IASB recommended policy and
reviewed by Attorney Maureen Heffernan. An explanation for the new policy was provided. Additional revisions were made to the policy and approved as edited. BP 803.1 will be brought forward to the full Board for first reading on Monday, August 10, 2020.

AR 803.1 – Internal Controls Procedures (NEW): Patty Blankenship

Conclusion: AR 803.1 was created by Ms. Blankenship based on the IASB recommended policy and
reviewed by Ms. Heffernan. An explanation for the new AR was provided. AR 803.1 will be brought
forward to the full Board for acknowledgment on Monday, August 10, 2020.

BP 800.1 – Expenditures for a Public Purpose (NEW): Patty Blankenship

Conclusion: BP 800.1 was created by Ms. Blankenship based on the IASB recommended policy and reviewed by Attorney Maureen Heffernan. An explanation for the new policy was provided. BP 800.1 was approved as presented and will be brought forward to the full Board for first reading on Monday, August 10, 2020.

AR 800.1 – Expenditures for a Public Purpose (NEW): Patty Blankenship

Conclusion: AR 800.1 was created by Ms. Blankenship based on the IASB recommendations and reviewed by Attorney Maureen Heffernan. An explanation for the new AR was provided. Reference to BP803.2 and AR803.2 – Purchasing and Credit Card Use will be added to the AR. AR 800.1 will be brought forward to the full Board for acknowledgment on Monday, August 10, 2020.

BP 803.5 – Payment for Goods & Services: Patty Blankenship

Conclusion: BP 803.5 was reviewed and edited by Patty Blankenship and Attorney Maureen Heffernan and presented to the Policy Committee on June 23, 2020. At that time, the Committee asked that BP 803.5 be brought back to Committee with new policies regarding Internal Controls and Expenditures for a Public Purpose. Revisions to BP 803.5 were approved as presented and will be brought forward to the full Board for first reading on Monday, August 10, 2020.

AR 803.5 – Payment for Goods & Services: Patty Blankenship

Conclusion: AR 803.5 was reviewed and edited by Patty Blankenship and Attorney Maureen
Heffernan and presented to the Policy Committee on June 23, 2020. At that time, the Committee
asked that AR 803.5 be brought back to Committee with new AR’s regarding Internal Controls and
Expenditures for a Public Purpose. Additional revisions were made to AR 803.5 and approved as
edited. Revisions to AR 803.5 will be included in the July 31, 2020, Informational Update and updated on the District website once the policy has been approved by the Board.

BP 103 – Discrimination and Harassment on the Basis of Race, Creed, Color, Sex, Sexual Orientation, Gender-Identity, Genetic information (for employment), National Origin, Religion, Age (for employment), Disability, Socioeconomic Status (for programs), Marital Status (for programs) or Veteran Status (for employment): Dr. Rita Vannatta and Jen Gomez

Conclusion: BP 103 was extensively reviewed and edited by Dr. Vannatta, Jen Gomez, Attorney
Miriam Van Heukelem (Ahlers Law Firm) and Attorney Maureen Heffernan to comply with new Title IX regulations. Due to the imminent August 14, 2020, effective date for the Title IX regulations, Ms.
Heffernan recommended following the emergency provision under BP 202.2-Adoption of Policy at the August 10, 2020 Board meeting.

AR 103(a) – Sexual Harassment: Dr. Rita Vannatta and Jen Gomez

Conclusion: AR 103(a) was reviewed and edited by Dr. Vannatta, Jen Gomez, Attorney Miriam Van
Heukelem (Ahlers Law Firm) and Attorney Maureen Heffernan to comply with new Title IX regulations. It was suggested that AR 103(a) be retitled to Procedures Related to Complaints of Sexual Harassment Under Title IX. Ms. Heffernan, Dr. Vannatta, and Jen Gomez will make final changes to the ARs acknowledged by the Committee. AR 103(a) will be included in the August 7, 2020, Informational Update and updated on the District website once the policy has been approved by the Board.

AR 103(b) – Complaints of Discrimination / Harassment: Dr. Rita Vannatta and Jen Gomez

Conclusion: AR 103(b) was reviewed and edited by Dr. Vannatta, Jen Gomez, and Attorney Maureen Heffernan. It was suggested that AR 103(b) be retitled to Complaints of Discrimination / Harassment not Covered by Title IX Sexual Harassment Procedures. Ms. Heffernan noted that she will be making some additional revisions for the Policy Committee to review and approve. AR 103(b) will be included in the August 7, 2020, Informational Update and updated on the District website once the policy has been approved by the Board.

AR 103(c) – Section 504 Student & Parental Rights: Dr. Rita Vannatta and Jen Gomez

Conclusion: AR 103(c) was reviewed and edited by Dr. Vannatta, Jen Gomez, and Attorney Maureen Heffernan. AR 103(c) will be included in the August 7, 2020, Informational Update and updated on the District website once the policy has been approved by the Board. Ms. Heffernan noted she will also be updating AR504.4 and sending same for review to the Committee in advance of including it in the August 7, 2020, Informational Update and updating it on the District website.

The next Board Policy Committee meeting will be held on August 18, 2020.
